RM of Laird No. 404 Public Notice – Zoning Bylaw Amendment

Public Notice is hereby given that the Council of the Rural Municipality (RM) of Laird No. 404 intends to adopt a bylaw under The Planning and Development Act, 2007, to amend Bylaw No. 6-2008, known as The Zoning Bylaw.

INTENT:  The proposed amendment would: allow for smaller than prescribed agricultural site sizes in the A-Agricultural District subject to new predefined criteria to remedy issues of access and agricultural parcel consolidations; allow for larger than prescribed site size in the AR-Agricultural Residential district subject to new predefined criteria; rezone from A to AR District a portion of land related to a proposed subdivision; and rezone a portion of land from M-Industrial/Commercial District to CR1-Country Residential 1 District to reflect current land use.

AFFECTED LAND:  Lands within the A and AR Districts would be affected by the proposed amendments providing site size flexibility. A portion of SE ¼ 1-41-7-W3M would be rezoned from A to AR District. Parcel A, Plan 101649180 Ext. 91, within SE ¼ 1-43-5-W3M, would be rezoned from M to CR1 District. A copy of the proposed amendment with maps showing the areas of rezoning are located for public view at https://rmoflaird.ca/category/rm-notices/.

REASON:  The RM is wishing to: provide some site size flexibility in the A and AR Districts where appropriate and consistent with its planning policies; rezoning a portion of land to the AR is required to accommodate a proposed subdivision; and rezoning to the CR1 District has been requested by the owner to reflect current land use which no longer includes a commercial component.

PUBLIC INSPECTION:  Any person may inspect the bylaw at the RM of Laird No. 404 office during regular office hours, excluding statutory holidays.  Draft copies of the proposed bylaw are available from the RM office; hard copy at cost, and a free digital copy is available at https://rmoflaird.ca/category/rm-notices/.   The RM office is located at 3025 Central Avenue, Waldheim, SK  S0K 4R0.   

PUBLIC HEARING:  Council will hold a public hearing on March 11, 2021, at 1:30 PM, in the Golden Age Centre located at 422 Main Street, Hepburn, SK, to hear any person or group that wants to comment on the proposed bylaw.  Due to current and anticipated COVID social distancing and assembly requirements, Council is intending to have an online participation component at the public hearing for those wishing to make verbal representation.  Parties interested in making representation are required to register for the online component and are encouraged to contact the RM office for details; the meeting itself will be open to the public to observe through the online component.  The deadline for receipt of written comments and requests for representation at the meeting must be received by the RM office by March 8, 2021.  For additional information, please contact (306) 945-2133 or administrator@rmoflaird.ca.

RM of Laird No. 404 Public Notice – Zoning Bylaw Amendment

Public Notice is hereby given that the Council of the Rural Municipality(RM)of LairdNo. 404intends to adopt a bylaw under The Planning and Development Act, 2007, to amend Bylaw No. 6-2008, known as The Zoning Bylaw.

INTENT: The proposed bylaw would: amend the general regulations clarify in which circumstances multiple principal buildings and uses would be allowed on a single site; within the AG-Agricultural District the heading for Accessory Building and Uses would be expanded to also include “Ancillary”;area requirements for accessory and ancillary uses and buildings would be clarified such that said uses and buildings comply with the site area requirements of the principal use; regulation and criteria would be provided for anciallary agricultural commercial uses; definitions for Building Grade, Butcher, and Municipal and Public Facilities would be added; Butchers would be added to the definition of Agricultural Commercial, and Historical and Cultural facilities would be added to the definition of Institutional Use; and a reference to a Figure would be deleted from the definition of Building Height.

AFFECTED LAND: All lands within the RM would be affected by the proposed amendments to the general regulations regarding multiple uses on a site, as well as the changes to defined terms. The AG District would be specifically affected by the proposed amendments related to ancillary uses and buildings.

REASON: The RM is wishing to:clarify instances in which multiple buildings and uses may be permitted on a site; guide the allowance and regulation of agricultural commercial accessory and ancillary uses within the AG-Agricultural District; and definitions would be added and revised to bring clarity to the employment of said terms.
